WEDDING PHOTOGRAPHY CONTRACT
It is agreed that the terms set out in this booking form is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing. This agreement is between Bride and Groom, hereinafter referred to as the “Client”, and Ian Peterson (stage name of Camilo Orozco, with ID No. AO307510 from Colombia, hereinafter referred to as the “Photographer”). The Photographer wills delivery digital photographs that visually narrate the Client’s wedding in the margins, times, locations and conditions written below.
The price of this contract is US$ 2.000
The Coverage time is 8 continuous hours without intervals from the bridal preparation, first look, ceremony, couple session, toast and reception. Delays generated in displacement, protocol development and event time are not deductible from the contracted coverage.
A non-‐refundable first payment is required to sing this contract. The Photographer will not book any other events on the same date once the first payment has been received. Full payment for the event is required at least days prior to the event. If full payment is not received 90 days prior to the event, the Photographer reserves the right to not be present to photograph the wedding event. Acceptable forms of payment include PayPal, cash or credit card.
Pre-Wedding session is a great way to capture the couple in a more relaxed setting and attire. It is also a good opportunity for you to see how I work, while building a rapport before the wedding day. If the pre wedding be held in a different city to Princeton MN must be added the travel cost for the Photographer.
The Client agrees to cheerful cooperation and communication by all parties for the best possible result within the definition of this assignment. The Photographer is not responsible if key individual’s failure to appear or cooperate during photography sessions or for missed images due to details not revealed to the Photographer. The Photographer recommends that client designate an “event guide” to point out important individuals that they wish to have photographed for informal or candid photographs during the wedding.
The Client understands and accepts that the photographic coverage will be as the Photographer expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made on behalf of the The Photographer to comply with the Client wishes. Any special requests not notified on this contract must be made by the Client to the Photographer in one mail. Reasonable efforts are taken to photograph family and friends in-‐group shots, however these will only be taken if time and weather permit. No responsibility is accepter for any specific individuals missing from group shots, for whatever reason. However, the Photographer will, at his discretion, attempt to meet reasonable requests. The Client will be responsible for (or have someone designated for this responsibility) identifying people/objects of whom/which specific photographs are desired. The The Photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying or gathering people for the photograph. The Client is also responsible for identifying any individual(s) that does not desire to be photographed.
Our shooting schedule, style of working and experience are designed to achieve a great set of wedding photos for the Client, accomplished with good humour and enjoyed by all concerned. Both the Client and the Photographers therefore agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases where the wedding does not run on time (for example, extreme lateness by one of the Client arriving to the church) we cannot guarantee to take our normal set of photos although in such circumstances we will do our absolute best to compensate.
The Photographer is limited by the guidelines of the ceremony official or the reception site manager. The Client agrees to accept the technical results of their imposition on the The Photographer. Negotiations with officials for moderation of guidelines are the client’s responsibility.
THE PHOTOGRAPHER LIMITATION OF LIABILITY
In the unlikely event of severe medical, natural or other emergencies on behalf of the the Photographer, every effort will be made to secure a replacement the Photographer able and/or willing to provide a similar package as chosen in this contract at a similar tariff. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. Limitation of liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, compact flash card malfunction, mail losses, or otherwise lost or damaged without the fault on the part of the Photographer. The Photographer shall not be liable for any amount in excess of the retail value of the Client paid order.
The Client grant the Photographer, the irrevocable and unlimited consent to use the photographs for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Client hereby release the Photographer, from all liability and claims in connection with the images.
On its own behalf, and on behalf of the subject, The Client acknowledges that it is familiar with the The Photographer’s portfolio and is requesting Services with knowledge of the The Photographer’s style; that The Photographer’s work is constantly evolving; that The Photographer’s services are of unique and artistic nature; that the photos may be different from photographs taken by the The Photographer in the past; and that in creating the photos, the The Photographer shall use his personal artistic judgment to create images consistent with his personal vision of the Event, which vision may be different from the Client’s and the Subject’s vision of the Event. Accordingly, Client acknowledges that the photographs shall not be subject to rejection on the basis of taste or aesthetic criteria.
FORCE MAJEURE OR ACT OF GOD
Performance of this contract shall be contingent upon Acts of God, flood, fire, warfare, Government laws or regulations, electrical failure, strikes by suppliers and/or conditions beyond it’s control.
CANCELLATION AND CHANGE OF DATES
Cancellation of services for the wedding event results in forfeit of all monies paid. All cancellations must be delivered in writing (verbal communication alone is not acceptable.) If the The Photographer cancels the agreement, then any fees and deposits will be reimbursed in full to the client. Changes to the venue or other important details must be submitted in writing to the The Photographer at least 14 days before the event. It is the Client’s responsibility to confirm all arrangements at least 2 weeks prior to the event. Changing the date of your wedding will incur a US$ 100 administration fee, in the event The Photographer is not available; the Client will have to cancel this contract.
One link will be sent to download all photos. The link will contain a minimum of 2.000 photographs in JPG format, All retouched redy for print (sRGB color profile, at least 3,000 pixels wide and 240 pixels per inch). The delivery will be sent to the Bride and Groom E-‐mail. The average delivery time is between 2 and 8 days after the wedding depending on workload.
PAPARAZZI WEDDING GUEST
All your guests will have digital cameras and all your guests will want to photograph the Client. In the spirit of cheerful cooperation the Client agree to give the Photographer precedence over the guests in order to take the photographs required for the wedding services described above. We cannot be held liable for a lack of wedding photos if guests taking their own photos of the Client continually interrupt the Photographer’s work.
BACKUP HARD COPIES
The Photographer keeps the Client hard copies on backup for 1 month. After that all images i.e. raw, jpeg, or any other proofs etc. are completely deleted from the Photographer files and cannot be recovered. Please make sure that you, the Client keep your images safe and backed up.
The photos receive basic editing i.e. sharpening, light adjustment, contrast, artistic editing and conversions. Extensive editing i.e. removal of wrinkles/scars/making thinner etc. cannot be done. The Photographer will not do any kind of ‘Photoshopping’.
The Client is required to provide meals for the Photographer and one assistant (if applicable)during the time when the meal is being served to the wedding guests. These may be served in the dining room or at another location in the reception venue. It is suggested that the Photographer and assistant be seated in the dining room if at all possible so as to be able to continue photography during the meal. These arrangements can be discussed between the Photographer and the Client.
We have understood the contents of this contract and agree to the terms therein. This contract is signed on__/__/____.
